DOJ Pursuing Perjury Charges Against James Comey

Reports from just a few hours ago said the DOJ was "weighing" whether or not to file charges against former FBI Director James Comey.

The Justice Department is weighing whether to charge former FBI Director James Comey with lying to Congress, two DOJ officials and a person familiar with the matter told NBC News Wednesday.

“There are still internal matters being sorted out,” one of the officials said...

The charge in question would involve testimony Comey delivered to Congress on Sept. 30, 2020, in response to a question from Sen. Ted Cruz, R-Texas, about the authorization of an information leak.

Fox News is similarly reporting that the Justice Department is moving forward with this case and a decision is close.

The Justice Department is seeking to indict former FBI Director James Comey for perjury as the deadline to bring charges looms, Fox News has learned.

The probe into Comey centers on whether he lied to Congress during his Sept. 30, 2020, testimony about his handling of the investigation into Russian interference in the 2016 U.S. presidential election...

"DOJ officials are close to deciding whether to prosecute former FBI Director James Comey for allegedly lying to Congress in September 2020," a source said. "There is a grand jury underway looking at the matter in Virginia. A decision could come any day."

There's a deadline in place. They only have until next Tuesday to either file charges or drop this for good. There has been a lot of behind the scenes shuffling and some pressure from President Trump to push this case forward.

"We can’t delay any longer, it’s killing our reputation and credibility. They impeached me twice, and indicted me (5 times!), OVER NOTHING. JUSTICE MUST BE SERVED, NOW!!!" he said in the Truth Social post on Saturday.

He told reporters later that day: “If they’re not guilty, that’s fine. If they are guilty, or if they should be judged, they should be judged. And we have to do it now.”

Trump fired Erik Siebert, the former US Attorney overseeing the case, and replaced him with one of his former personal attorneys.

With Siebert’s ouster and the deadline for a charge against Comey nearing, Trump this week installed Lindsey Halligan, one of his former personal lawyers, as acting US Attorney in the Alexandria-based Eastern District of Virginia. Halligan has been spotted in recent days at the Justice Department headquarters as decisions on Comey and other cases loom.

It's not completely clear (to me) what perjury charges will be brought here. However, one clue suggests it might have to do with the leak of those memos Comey wrote to himself about his conversations with Trump. Comey testified in 2017 that he had leaked those memos to a friend at Columbia University and then told the friend to leak them to the NY Times. Last week, it was reported that Comey's friend had received a subpoena.

A Columbia law professor who is a friend and adviser to former FBI Director James Comey was subpoenaed last week by federal prosecutors in connection with a criminal probe into whether Comey allegedly lied in testimony before Congress, sources familiar with the matter told ABC News. 

Daniel Richman has previously acknowledged his role as an intermediary between Comey and reporters in the wake of Comey's 2017 firing by President Donald Trump during his first term over Trump's anger with the FBI's investigation into his 2016 campaign. 

Richman met with federal prosecutors in the Eastern District of Virginia on Tuesday, sources familiar with the matter said. 

That's one possibility of what these perjury charges could be about, but again it's not entirely clear. We shouldn't have to wait much longer to find out. If they are going to do this they only have a few more days to move forward.
